These Terms of Service ("Terms") govern your access to and use of the DayOneCloud mobile application (the "App"), provided by DayOneCloud ("we", "us", or "our").

1. Eligibility

Age Requirement

You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or legal guardian.

Account Creation

To use the App, you must:

• Provide accurate and complete information
• Maintain a secure password
• Be responsible for all activity under your account
• Notify us immediately of unauthorized access

Prohibited Users

You may not use the App if:

• You have been previously banned
• You are located in a country under U.S. trade embargo
• You are on a U.S. government prohibited parties list

2. License to Use

Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

Restrictions

You may not:

• Modify, reverse engineer, or decompile the App
• Remove copyright or proprietary notices
• Use the App for commercial purposes without permission
• Transfer your account to another person
• Use automated tools (bots, scripts) to access the App
• Attempt to gain unauthorized access to our systems

3. User Conduct

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm other users
• Upload malicious code or viruses
• Spam or send unsolicited communications
• Impersonate another person or entity
• Collect other users' information

4. In-App Purchases

Virtual Currency

The App may offer virtual currency ("Coins") for purchase with real money. Coins have no real-world value and cannot be exchanged for cash.

Payment

• All purchases are final and non-refundable except as required by law
• Prices are subject to change without notice
• You are responsible for all charges incurred
• Payment processing is handled by Apple App Store or Google Play Store

Refunds

Refund requests should be directed to the App Store or Play Store where you made the purchase. We do not control store refund policies.

5. Intellectual Property

Our Content

All content in the App, including text, graphics, logos, code, and episodes, is owned by DayOneCloud or our licensors and protected by copyright and trademark laws.

Your Content

Any content you create or submit (profile information, feedback) remains yours, but you grant us a worldwide, royalty-free license to use, display, and distribute it within the App.

AWS Trademark Notice

AWS and related marks are trademarks of Amazon.com, Inc. or its affiliates. DayOneCloud is not affiliated with, endorsed by, or sponsored by Amazon Web Services. All AWS service names are used for educational purposes only.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

7. Disclaimers

Educational Content

The App provides educational content about AWS services. While we strive for accuracy:

• Content is for educational purposes only
• AWS services change frequently; some content may become outdated
• We do not guarantee certification exam success
• Consult official AWS documentation for production implementations

No Warranty

The App is provided "AS IS" without warranties of any kind. We do not guarantee that the App will be:

• Error-free or uninterrupted
• Secure from unauthorized access
• Free of viruses or harmful components
• Compatible with all devices

8. Limitation of Liability

To the maximum extent permitted by law, DayOneCloud shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Damages resulting from unauthorized access to your account
• Third-party actions or content

Our total liability shall not exceed the amount you paid us in the last 12 months, or $100, whichever is less.

9. Termination

By You

You may delete your account at any time through the App settings. Upon deletion, your data will be removed according to our Privacy Policy.

By Us

We may suspend or terminate your account if:

• You violate these Terms
• Your account shows suspicious or fraudulent activity
• We discontinue the App
• Required by law

Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You lose access to your account and progress
• Unused virtual currency is forfeited (no refund)
• Certain provisions of these Terms survive (payment obligations, disclaimers, etc.)

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the new Terms in the App
• Updating the "Last Updated" date
• Sending an in-app notification or email

Continued use of the App after changes constitutes acceptance of the new Terms.

11. Dispute Resolution

Informal Resolution

Before filing a claim, please contact us at support@dayonecloud.app to attempt informal resolution.

Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

Arbitration

Any disputes shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class actions.

12. General Provisions

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and DayOneCloud.

Severability

If any provision is found invalid, the remaining provisions remain in effect.

No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

Assignment

You may not transfer these Terms. We may assign our rights and obligations.
